(Oral) The grievance of the petitioners is that though they hold the promotional posts namely Laboratory Assistant from the post of Laboratory Attendant, however, their pay scales are equated from the feeder post to their promotional post. The parity in pay and other allowance has not been granted with the government employee, as the pay scale of similarly situated persons has been revised to the promotional pay scale of Junior Lecture Assistant or Senior Lecture Assistant.

The petitioners are Laboratory Assistant working in the recognized affiliated respondent-college who is receiving 95% grant in aid from the State of Haryana.

Reference has been made to C.W.P No. 5492 of 1997, GAURAV ARORA 2016.01.22 13:31 I attest to the accuracy and integrity of this document

C.W.P No. 26 of 2016 -2decided on 20.11.2013 (P-3) where by the similarly situated employees (Lab Assistants) working in the aided colleges were granted the promotional pay scale of SLA/JLA, equivalent to their counterparts working in the Government college.

Learned counsel for the petitioners submits that no SLP has been filed against CWP No. 5492 of 1997.

The petitioners have also submitted a representation dated 27.08.2015 (Annexure P-4) in this regard, but no decision has been taken thereon.

Learned counsel for the petitioner states, that at this stage, the petitioner will be satisfied, if directions are issued to respondents to decide the representation, referred to above. In view of above, without commenting on the merits of the case, this petition is disposed of with a direction to respondent No. 2 and 3 to consider and decide the representation of the petitioners dated 27.08.2015 (Annexure P-4) by passing a speaking order expeditiously, preferably, within a period of three months from the date of receipt of certified copy of this order, in view of CWP No. 5492 of 1997, decided on 20.11.2013.
