Present civil revision petition has been preferred under Article 227 of the Constitution of India by the petitioners for setting aside the impugned order dated 27.04.2026 (Annexure P-9) whereby objections filed by petitioners under Section 47 CPC, 1908 were dismissed and warrants of attachment were issued and for setting aside order dated 14.05.2026 (Annexure P-10) whereby notices under Order XXI Rule 66, CPC, 1908 were issued for proclamation and sale of attached properties passed by learned Additional Civil Judge (Senior Division), Safidon. 2.

Sh. Rishabh Gupta, Advocate has put in appearance on behalf of respondent and filed his memo of appearance. 3.

Learned counsel for the petitioners after arguing unsuccessfully for some time submitted that petitioners are ready to make the payment, if they be allowed to make the payment in installments. CR-4518-2026 -2counsel for the petitioners that they shall deposit Rs.40,00,000/- by 01.06.2026 and thereafter, Rs.15,00,000/- by 7th of every month till the entire decretal amount along with interest is released. The said offer has been accepted by learned counsel for the respondent. Issue of interest from today onwards is left open for discussion between parties. 4.

Therefore, the first payment of Rs.40,00,000/- is expected to be made by 01.06.2026 and remaining payment starting from 07.07.2026 amounting to Rs.15,00,000/- per month, shall be paid by the petitioners till the realization of the entire decretal amount along with interest till today. In case, petitioners makes payment of Rs.40,00,000/- on or before 01.06.2026, the learned Executing Court shall not proceed with the auction of attached property. The matter before learned Executing Court shall be deferred and shall only be re-opened in case, petitioners fails to make the payments as per compromise, and shall proceed with the execution. 5.

Present civil revision petition is disposed of in above terms. 6.
