G.S.SANDHAWALIA, J. (Oral) A perusal of the writ petition would go on to show that directions are sought to protect the life and liberty of the petitioner who is Senior Technocrat and for action on his representations. A perusal of Annexures P-16 and P-17 would also go on to show that applications were filed under Section 340 Cr.P.C. in Crl. Misc. No. M-20385 of 2015 by the said applicant/petitioner for initiating proceedings against private respondents namely respondents no. 5 and 7, which have been dismissed on 18.07.2018 (Annexures P-16 and P-17) in a petition filed under Section 482 Cr.P.C., which had been disposed of on 24.06.2015 (Annexure P-2). In such circumstances, ex facie, this Court is not inclined to invoke its jurisdiction under Articles 226 and 227 of the Constitution of India.
Faced with this situation, counsel does not press the present writ petition and prays for withdrawal of the same with liberty to take recourse to his alternative remedy including under Section 482 Cr.P.C. in accordance with law, if permissible.
