SURYA KANT, J.(ORAL) The Court was informed yesterday in CWP No.3928 of 2017 that a new 'Oustees Policy' has been approved by the Competent Authority and is likely to be notified within few days. It was also stated that as soon as the new policy would be notified, advertisements inviting claims of the oustees will be issued. In the instant case, land of the petitioner was acquired for development of residential and commercial area of Sector-9, Part 32 & 33 in the Urban Estate, Karnal. The petitioner has been denied consideration for allotment of a plot under the category of 'Oustees' only on the ground that he did not apply when such claims were invited on 08.07.2006, 09.07.2006 and 28.01.2007. However, the impugned order also acknowledges that the petitioner will be entitled to apply afresh as and when applications would be invited under the 'Oustees Quota' in terms of Meenu 2018.07.25 13:40 I attest to the accuracy and authenticity of this document chandigarh

[2] In the light of the facts noticed above, and for the reason that the oustees should not be forced to wait endlessly, the writ petition is disposed of with a direction that let the claims under the 'Oustees Quota' in respect of acquisition of land of the petitioner or other similarly placed Oustees, as may be deemed appropriate by the Competent Authority, be invited within a period of four months from the date of receipt of a certified copy of this order. The petitioner shall be at liberty to apply in response to the fresh advertisement and his application shall be considered as per law/Policy.
