Prayer in this petition is for quashing impugned order/letter dated 19.05.2016 whereby claim of the petitioner for grant of 3rd ACP has been rejected and for a direction to the respondents to grant 3rd ACP to the petitioner w.e.f. 01.10.2014 on completion of 24 years of service and release arrears of pay alongwith interest at the rate of 12% per annum. Respondents in the short reply filed on behalf of respondents No. 1 to 5 have relied upon judgment dated 05.08.2009 passed by a Division Bench of this Court in CWP-14653-2008 titled as Rakesh Kumar versus State of Haryana and others. Learned counsel for the petitioner is unable to deny that matter is squarely covered against the petitioner as per the said decision. Writ petition is, accordingly, dismissed.
