The petitioner is aggrieved that the 4th respondent, who tied with him on the marks secured for the final examination conducted by the Council of Indian School Certificate Examination, has been awarded the 1st rank. The several representations given by the petitioner have not been considered. The reply by the 3rd respondent is that as per the ICSE board guidelines published in newspaper, the position of 1st, 2nd,in case of equal ranks, had to be decided by taking the best of five subjects marks scored i.e. English and any best of four vis-a-vis the candidate. The tabulation has been brought forth in the reply of the 3rd respondent that shows that the 4th respondent has the benefit of being placed in highest rank in view of the fact that the best highest marks in the four subjects secures to him a higher tally than the petitioner. The

CWP No.3409 of 2014 -2issue of who will rank first in case of equal marks is invariably a matter of how the Council itself sets its guidelines and I will find nothing arbitrary in this. Indeed, in several States the State School Boards or matriculation boards provide for such manner of reckoning in case of equal marks. I will not find that there is a scope for intervention. 2.

The writ petition is dismissed.
