**** SATISH KUMAR MITTAL, J.(Oral) On 01.04.2015, following order was passed by this Court: "Sections 3, 4 (2), 6 (1) (c), 13 (1), 14 of the Punjab Prevention of Human Smuggling Act, 2012 (hereinafter referred to as `the Act') and Rules 3 (2), 3 (3), 4 (1) (iv), 4

(1) (vii), 4 (2), 4 (6)of Punjab Prevention of Human Smuggling Rules, 2013 (hereinafter referred to as `the Rules').

Learned counsel for the respondents states that during the pendency of this petition, various provisions of the Act and the Rules, which have been challenged in this petition, have been amended. The amended Act and Rules have been placed on record. He further states that some other travel agent association, similar to that of the petitioner herein, has already challenged those amended provisions, and the said matter is pending adjudication before this court. In view of the aforesaid fact, learned counsel for the petitioner seeks time to have instructions with regard to

CWP No.345 of 2014 #2# withdrawal of this petition with liberty to file fresh one challenging the amended Act and Rules.

Adjourned to April 23, 2015."

On the last date of hearing, the following order was passed: "Last opportunity is granted to learned counsel for the petitioner to get the instructions in terms of earlier order passed by this Court."

Today, learned counsel for the petitioner states that let the petitioner be permitted to withdraw the present petition with liberty to file a fresh one on the same cause of action including challenging the amended provisions.
