(ORAL) The petitioner herein has approached this Court by way of filing a writ petition under Article 226/227 of the Constitution of India seeking a direction to the respondents to revise the merit list and award him marks for his height, which is stated to be 6 feet. Learned counsel appearing for the petitioner would contend that height of the petitioner as measured by CMO, Barnala was 6 feet, however, his height had been measured during the recruitment process at 5' 11".

Learned counsel appearing on behalf of the respondent-State would submit that height of the petitioner was re-measured at Government Multi-Speciality Hospital, Sector 16, Chandigarh, which is a totally independent body and it has been found to be 5' 11.2" and not 6 feet as claimed by him. Consequently, there would be no difference in the marks allotted to him.

Faced with this position, counsel for the petitioner does not press the instant petition.

Dismissed as not pressed.
