This petition has been filed under Section 528 BNSS, 2023 for issuance of directions to the official respondents to hand over the investigation of the case i.e. FIR No. 0192 dated 16.08.2021 under Sections 279,337,427 IPC registered at Police Station Kharar to some independent investigating agency or be got investigated by constituting a Special Investigating Team (SIT).

Learned counsel for the petitioner contends that the petitioner has preferred a representation/complaint dated 13.07.2022 (Annexure P-2) to respondent No.3-Senior Superintendent of Police, SAS Nagar, Mohali, Punjab but no action has been taken so far. Learned counsel submits that he would be satisfied if directions are issued to respondent No.3-Senior Superintendent of Police, SAS Nagar, Mohali, Punjab to look into his representation/complaint and take appropriate steps at the earliest. 3.

Keeping in view the facts and circumstances of the case and the limited prayer made by the petitioner, the present petition is disposed of with a direction to respondent respondent No.3-Senior Superintendent of Police, SAS Nagar, Mohali, Punjab to consider and decide the representation/complaint dated 13.07.2022 (Annexure P-2) of the petitioner in accordance with law within a period of two months from the date of receipt of certified copy of this order.
