Today, at the very outset, learned counsel representing the petitioner submits that the present petition may be disposed of by issuing a direction to the respondent - authority to consider the case of the petitioner for reinstatement in light of policy dated 14.5.2008 (Annexure P-11) and also in light of judgments passed by this Court in CWP-7049-2009 titled as Harpal Singh Versus State of Punjab and others, decided on 13.1.2016 (Annexures P-13) & in CWP-14975-2009 titled as Pawan Kumar (Constable) Versus State of Punjab and others, decided on 13.1.2016 (Annexure P-14). 2.

Learned State counsel submitted that the case of the petitioner can be considered in accordance with rules and policy and also in light of law laid down by this Court in the aforesaid judgments provided the case of petitioner found to be fully covered by the said policy/judgments and also provided the certificates of the petitioner are found to be genuine. In view of the aforestated position, the instant petition is disposed of with a direction to the authorities concerned to consider the case of the petitioner for reinstatement in accordance with policy dated 14.5.2008 (Annexure P-11) and judgments passed by this Court in Harpal Singh's case (supra) and Pawan Kumar's case (supra) expeditiously preferably within a period of 3 months from today, subject to the conditions as indicated by the State counsel. 4.

In case, it is found that the petitioner is entitled to any benefit particularly any monetary benefit, the same shall be paid within a period of 2 months thereafter alongwith interest @5% per annum. In case, the monetary benefit, if found due, is not paid within the aforesaid prescribed period, the respondents shall be bound to pay the same alongwith interest @10% per annum.
