After realizing that the Court is not inclined to grant the relief in view of the fact that the contraband recovered amounts to commercial quantity attracting bar of Section 37 of the NDPS Act, learned counsel for the petitioner states that he be permitted to withdraw the present petition, however, a direction be issued to the trial Court to conclude the trial expeditiously. Permission is granted. The petition is dismissed as withdrawn. The trial Court is directed to make earnest efforts to conclude the trial expeditiously preferably within a period of six months from the date of receipt of copy of order in that Court.
The State counsel has been asked to ensure the appearance of PWs in the trial Court on the dates of hearing. Of course, no request for adjournment shall be made on behalf of the accused for recording statement of prosecution witnesses. (H.S.
