The petitioners are seeking the concession of anticipatory bail under Section 438 of the Cr.P.C. in case FIR No.171 dated 20.06.2023 under Sections 458, 323, 506, 294, 427, 148, 149 of the Indian Penal Code, 1860, and Section 11 of the Prevention of Cruelty to Animals Act, 1960, registered at Police Station City Rajpura, District Patiala. 2.
On the last date of hearing i.e. on 19.07.2024, while noticing the following submissions made by the learned counsel for the petitioners, this Court had granted the concession of interim bail to the petitioners and asked them to join investigation:- "Learned counsel for the petitioners, inter alia, contends that a perusal of the FIR, which has been annexed as Annexure P-1 reveals that petitioner No.1 has been attributed fist blows on the complainant and qua petitioner No.2, though his name does figure in the FIR, however, no injury has been attributed to him." Learned counsel for the petitioners submits that in compliance of order dated 19.07.2024, the petitioners have joined investigation and cooperated with the investigating agency.

Learned State counsel, on instructions, does not dispute the factum of the petitioners having joined investigation and cooperated with the investigating agency. He, on further instructions, submits that the petitioners are not required for further investigation much less for their custodial interrogation.

In view of the above, the petition is allowed and interim order dated 19.07.2024, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C./482(2) of BNSS, 2023.
