Mr. Bharat Bhushan Sharma, Advocate, for the petitioner. KRISHNA MURARI, C.J. (ORAL) When confronted with the observation with respect to the maintainability of this Public Interest Litigation, in view of the fact that the petitioner had already invoked jurisdiction of this Court by filing an earlier PIL for the same relief based on the same cause of action, which was disposed of vide order dated 20.11.2015, giving liberty to the petitioner to make a representation before the Municipal Corporation for redressal of the grievances, learned counsel submits that since despite having made representations, there has been no response for sufficiently long period, hence he has again approached this Court.

In our opinion in case the directions issued by this Court have not been followed, the remedy lies somewhere else and this subsequent petition based on same cause of action would not be maintainable. At this stage, learned counsel made a request to permit withdrawal of the petition with liberty to avail such other remedy, which may be available in law.
