HARINDER SINGH SIDHU, J The case has been taken up by way of Video Conference as per instructions in view of COVID-19 pandemic.

This is a petition filed under Section 439 Cr.P.C. for grant of bail in case FIR No. 1055, dated 6.11.2019, registered under Sections 399, 402 IPC and under Sections 25, 54 of Arms Act, 1959 at P.S. Chandni Bagh, District Panipat.

As per allegations in FIR, a secret information was received by police on the intervening night of 5/6.11.2019 with regard to presence of 56 young boys armed with weapons at Ugra Kheri turn who were in lookout to rob passers-by. The petitioner is alleged to be one of them having torch in his hand. The police party raided the spot and petitioner alongwith co accused was apprehended.

Petitioner is in custody since 6.11.2019. Investigation in the case is complete, challan has been filed and charges have been framed against petitioner.

CRM-M-37166 of 2020 #2# Keeping in view the aforesaid and also the fact that trial of this case will take a long time, in my opinion, no useful purpose will be served by detaining the petitioner behind bars. Accordingly, petition is allowed. Petitioner Tejbir is ordered to be released on bail on his furnishing bail and surety bonds to the satisfaction of trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
