Mr. Suresh Kumar Kaushik, Advocate for the petitioner. **** AMIT RAWAL, J. (ORAL) Learned counsel for the petitioner submits that parent department of petitioner had sent the requisite documents to Administrative Secretary i.e. respondent No.3/Additional Chief Secretary, Government of Haryana, Department of Administration of Justice for considering the candidature of petitioner to the post of Haryana Civil Services (Ex. Branch), in pursuance to Advertisement No.4 of 2019 dated 13.06.2019 (Annexure P-2), but respondent No.3 did not send the said documents to the Haryana Public Service Commission/respondent No.2, in time, resulting into, rejection of candidature of petitioner.

In my view, the aforementioned contention of learned counsel for petitioner cannot be now accepted by putting clock back and petitioner has an independent remedy to claim damages.

Faced with the aforesaid situation, learned counsel for petitioner seeks permission of this Court to withdraw the present writ petition with liberty to avail appropriate remedy, in accordance with law. Ordered accordingly.
