***** SANJIV BERRY. J. (Oral) By way of present petition filed under Section 438 of the Code of Criminal Procedure, 1973, petitioners seek anticipatory bail in case FIR (Annexure P-1) as under:

Dated Sections Police Station 06.06.2022 147, 149, 447, 506 IPC (384 IPC added later on) Sadar Ratia, Tehsil Ratia, District Fatehabad 2.

Learned counsel for the petitioners submits that in compliance to the order dated 24.08.2023 passed by this Court, the petitioners have already appeared in the trial Court and furnished their bail bond. In support of his contention, he has placed on record a copy of the order dated 29.08.2023, passed by learned Judicial Magistrate First Class, Ratia corroborating this fact. 3.

Learned State counsel has not disputed this fact. 4.

Challan in this case has already been presented in the Court and the criminal liability, if any, of the petitioners would be determined after the completion of trial. Therefore, at this stage, when the petitioners have already SANDAL SHARMA 2023.09.25 12:53 I attest to the accuracy and authenticity of this order/judgment

N.C. No.2023:PHHC:125016 CRM-M-35833-2023 (O&M) -2appeared in the trial Court to face the trial and furnished their bail bonds in compliance to the order dated 24.08.2023, without commenting on the merits of the case, the order dated 24.08.2023 granting interim bail to the petitioners is hereby confirmed in the present FIR No.154 dated 06.06.2022 under Sections 147, 149, 447, 506 IPC (384 IPC added later on), at Police Station Sadar Ratia, Tehsil Ratia, District Fatehabad subject to conditions as envisaged under Section 438(2) Cr.P.C. that the petitioner will come and join the investigation as and when so required; will not tamper with the evidence and will not leave the country without prior permission and will appear in Court on each and every date of hearing. 5.

The petition stands allowed.
