Due to COVID-19 situation, the Court is convened through video conference.

This petition is filed for setting aside order dated 17th October, 2018 passed by the District Magistrate, Rohtak whereby surety furnished by the petitioner is ordered to be forfeited to the State. After arguing for some time and realizing that impugned order was passed under Section 446 Cr.P.C. and appeal is provided in statute, learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to avail remedies in accordance with law.
