Petitioners have filed present petition for issuance of direction to respondent Nos.2 i.e. Block Development Officer and respondent No.3 Station House Officer, Police Station Beas, to take action against respondent No.4 namely Amrik Singh (Lambardar) on the representation dated 06.08.2021 filed by him.

Prime allegation in the present petition is that respondent No.4 has encroached upon the pond (Chhapar) of the village and is also constructing house on the common land of the village. 3.

Status report was filed by the State of Punjab by way of an affidavit of Kulwant Singh, BDPO, Block Rayya, District Amritsar. 4.

In para 6 of the said status report, it has been pleaded that Gram Panchayat/Village Rajpur has already filed eviction petition on 12.10.2021 for evicting the respondent No.4 from the illegal possession of the Gram LAVISHA 2025.01.13 10:34 I attest to the accuracy and authenticity of this order/judgment Punjab & Haryana High Court, Chandigarh

CRM-M-41728-2021 -2Panchayat Land, and the said eviction petition is pending before the court of District Development and Panchayat Officer, Amritsar. 5.

In view of the explanantion given in the status report, this Court does not find any reason to permit the continuation of the present petition, more for the reason that no substantive cause survives with the petitioners to raise such a plea directly before this Court by way of filing such petition under Section 482 Cr.P.C.

With the aforementioned reasons, present petition is hereby dismissed.
