(ORAL) Prayer of the petitioner in the present writ petition is for issuance of directions to the respondents for counting his service rendered in Punjab Home Guard department from 30.06.1981 till 19.10.1989 as a qualifying service for the grant of pensionary benefits. The claim of the petitioner is that he had worked under the Government of Punjab as a Corporal Instructor in the Department of Punjab Home Guard from 30.06.1981 to 19.10.1989, whereafter he was appointed as a Patwari in the Department of Revenue from where he ultimately retired on 31.10.2014. The prayer of the petitioner is that under the Punjab Civil Services Rules, the service rendered under the State is to be counted as a qualifying service for the grant of pensionary benefits. CWP-20930-2019 -2From the averments, it transpires that for the relief, which has been sought in the present writ petition, petitioner has also served the respondents with a legal notice dated 01.05.2019 (Annexure P-10), which is still pending consideration with the respondents. Interest of justice will be served, at this stage, in case a time bound direction is issued to the respondents to decide the said legal notice by passing an appropriate speaking order.

Without expressing any opinion on the merits of the case and entitlement of the petitioner in respect of the claim made in the writ petition/legal notice, the respondents are directed to decide the legal notice dated 01.05.2019 (P-10) within a period of three months from the date of receipt of a certified copy of this order. In case it is found that the petitioner is entitled for any relief, the same shall also be released to him within a period of next three months.
