-.- AMIT RAWAL J.(ORAL) Mr. Puri, learned counsel appearing on behalf of the appellantdriver submits that the matter has been compromised between the parties and place on record copy of order dated 26.02.2013, which reads as under:- "The respondent has given the statement he has compromised the matter with the claimant Balram Chadha vide compromise mark-A and he has no objection if the amount of Rs.2,75,000/- deposited by him in the shape of FDR is paid to Balram Chadha claimant. Accordingly, a letter be sent to the concerned bank to convert the amount of said FDR in the name of claimant Balram Chadha in the shape of FDR for a period of two years and accordingly, counsel for the claimant has given the statement regarding withdrawal of this application. Therefore, this application stand disposed off as satisfied. These papers be attached with the main file and be consigned to the record room under rules.

In view of the aforementioned factum, he prays for dismissal of the appeal as having become infructuous.

However, he further submits that the statutory amount of `25,000/- as deposited by the appellant at the time of filing of the appeal may kindly be refunded to him.

Ordered accordingly. The amount of `25,000/- is ordered to be refunded to the appellant-Jarnail Singh son of Amrik Singh in accordance with law.
