(ORAL) Challenge in this petition has been made to one of the eligibility criteria prescribed in the tender notice, by the petitioner company claiming itself to be a prospective bidder. Challenge is confined on the ground that in respect of the same department, tenders invited in other States does not contain this eligibility criteria. Be that as it may. The eligibility criteria is to be decided by the experts and the Court cannot sit in appeal over the same. The comparison drawn by the petitioner is not at all justified because the experts may have taken this decision looking at the nature of the work and the specific requirements of the area where the work is to be carried out.
