 and decision being arisen out of the same FIR, at request and with consent of learned counsel for the parties.

As per facts of the case, a written complaint was filed regarding misbehaviour and threats given by the persons who tried to flee along with tipper No.HP-20G-2311 which was duly challaned. It is alleged that on 27.01.2024 at about 3.48 pm, a tipper was stopped at village Swamipur loaded with gravel mixture and on checking said driver could not produce any legal document for carrying gravel mixture. Therefore, in challan book No.31 at serial No.20 vehicle was challaned and intimation was given regarding the aforesaid tipper. After some time 4 persons reached there in Maruti Suzuki A-Star car bearing No.PB-10DC-4162 and started misbehaving with the official of Mining Department. They tried to block the way of Government vehicle and also made an attempt to flee with tipper. Mining team tried to stop even then they managed to escape with challaned tipper. With these allegations, present FIR has been registered. 3.

Learned counsel for petitioners in both bail applications argued that they have already joined the investigation and they are not required for any other purpose. Car and aforesaid tipper allegedly involved in this occurrence are already recovered. They will abide by the terms of bail order.

Status report is filed today in CRM-M-34618-2024 with the prayer that this status report be also read in other bail application bearing CRM-M-37863-2024. It is confirmed that accused persons have already joined investigation as per the directions of this Court. They are not required for any other purpose. After completion of investigation challan will be presented before the trial Court. It is further pointed out that

 petitioner Ravi Kumar is also involved in two other FIRs. 5.

I have considered the arguments and have gone through the record. As referred above, petitioners involved in this case have already joined investigation. Alleged recoveries have already been effected. They are not required for any other purpose. So far as other FIRs against petitioner Ravi Kumar are concerned, those cases will be decided on its own merits. Therefore, without expressing my mind on the merits of the case, anticipatory bail applications filed by aforesaid petitioners are accordingly allowed. Interim bail already granted to petitioners Ravi Kumar, Rajesh Kumar and Sarvan Kumar vide order dated 22.07.2024 [CRM-M-34618-2024] and petitioner Sapan Kumar [CRM-M-378632024] vide order dated 06.08.2024 stand confirmed subject to same terms and conditions.
