The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking quashing of notification No.122/PS/TC/2026 dated 02.01.2026 whereby respondent No.2-Transport Commissioner, Haryana has imposed a pre-condition of paying challan/outstanding dues for release of vehicle. He is further seeking direction to respondent No.3-District Transport Officer-cum-Secretary, Registration Transport Authority, Faridabad to accept penalty amount of ₹1,29,000/- against Challan No. HR335004260513061952 and release his vehicle.

The petitioner is a registered owner of commercial tipper truck bearing No.HR-38-AJ-0017 which was challenged on 13.05.2026 by SUDEEPAK KUMAR 2026.05.29 17:33 I attest to the accuracy and integrity of this document
-2Transport Authorities, Gurugram and penalty of ₹1,29,000/- was imposed. His vehicle has been impounded. He approached RTA, Gurugram seeking release of his vehicle which refused to release the vehicle citing notification dated 02.01.2026. The petitioner claims that two earlier challans dated 04.11.2025 and 26.11.2025 are pending adjudication before Additional Chief Judicial Magistrate, Gurugram vide CRM/4550/2026 and CRM/4547/2026.

Learned counsel for the parties are ad idem that instant petition may be disposed of in terms of order dated 12.03.2026 passed in CWP No.5962 of 2026 titled as "Kaviraj Vs. State of Haryana and Others". 4.
