***** JASPAL SINGH, J By virtue of instant petition preferred under Article 226/227 of the Constitution of India, petitioner has sought issuance of a writ in the nature of mandamus, directing the respondents to grant him the pension and all other retiral benefits as well as ACP pay scale by adding previous service rendered by him with respondent No.4 w.e.f. 26.04.1979 to 30.06.2002 with interest @ 18% per annum on unpaid amount of pension, commutation, gratuity, leave encashment, GIS etc. and ACP pay scale.

At the very outset, learned counsel for the petitioner submits that though legal notice dated 20.09.2017 (Annexure P-9) was duly served upon the respondents but till date no conscious decision has been taken by them. He further submits that petitioner feels satisfied in case direction is issued to respondent(s) to decide aforesaid legal notice, within a stipulated period. 3.

CWP No.2108 OF 2018 --2-- instant petition is disposed of with the direction to respondent(s) to look into the grievances unfolded by the petitioner in legal notice dated 20.09.2017 (Annexure P-9) and to take a conscious decision, in accordance with Rules, Regulations as well as judgment rendered in case LPA No.1805 of 2016 (O&M), titled as "Haryana State Agricultural Marketing Board and another v. Prem Parkash Gupta and others", which has attained finality on account of dismissal of SLP preferred by Haryana State Agricultural Marketing Board, within a period of 3 months from the date of receipt of certified copy of this order.

However, if the petitioner still feels aggrieved against any of the order(s) passed by the concerned authority, he shall be at liberty to approach this Court.
