Through instant petition preferred under Article 226/227 of the Constitution of India, petitioner has sought issuance of a writ in the nature of mandamus directing the respondents to refix/revise the pension and other retiral benefits after counting service rendered by him in Military, during emergency period.

At the very outset of the arguments, it has been submitted by learned State counsel that the relief sought by the petitioner through instant petition has already been granted to him, which fact is otherwise evident from letters both dated 15.09.2016 (Annexure R-3/1 and R-3/2). 3.
