The petitioner, in a way, seeks an injunction order against the official respondents to restrain them from registering any sale deed and/or any other instrument on behalf of the private respondents in respect of the land situated in village Nada, Tehsil Khara, District SAS Nagar Mohali which is described as Hasab Rasad Zar Khewat and is comprising Khewat-Khatoni No.195/220, Khasra No.129/1.

While it may be true that a co-sharer is not entitled to sell the land exceeding his share but such like question of facts, in our considered view, can be effectively resolved by the Civil or Revenue Courts where the petitioner may also seek partition of the joint-holding. We have no reason to doubt that any such proceeding initiated by the petitioner would be expeditiously disposed of.
