**** AMIT RAWAL, J. (ORAL) Learned counsel for the petitioner submitted that the petitioner obtained matriculation certificate dated 05.07.1991 (Annexure P-1) from Varanasey Sanskrit Vishwavidyalaya, Varanasi which was held to be recognized equivalent to High School Examination in State of Haryana as held by a Division Bench of this Court in CWP-14357 of 1990 titled as "Raj Bala V/s State of Haryana and others", decided on 13.02.1991. The petitioner jointed on the post of Peon on 12.05.1982 and promoted as Clerk in the year 1985. On the basis of matriculation certificate, the petitioner was selected/promoted on the post of Secretary and now after completing 36 years of service, his services has wrongly been terminated on the ground that Varanasey Sanskrit Vishwavidyalaya is not recognized University, as per letter issued by Director of Higher Education, Haryana.

YOGESH SHARMA 2019.07.23 10:14 I attest to the accuracy and integrity of this document CWP-21107-2018 (O&M) Mr. Ramesh Sharma, learned counsel appearing on behalf of the respondent(s) submitted that as per Rule 31 of the Haryana State Central Cooperative Bank Staff Service (Common Cadre) Rules, 1975, the petitioner has alternative remedy of appeal. He further submits that the petitioner has been retired from service.

Faced with the aforesaid situation, learned counsel for the petitioner seeks permission of this Court to withdraw the present writ petition with liberty to avail the remedy of appeal, in accordance with law. Ordered accordingly.
