***** ARCHANA PURI, J. (Oral) As observed in the order dated 10.02.2025, despite service, the respondent did not make appearance on that date. Even today, none has made appearance on his behalf. As such, the respondent is proceeded against ex parte.

The counsel for the applicant heard.

The present application has been filed by the applicant-wife, for seeking transfer of the petition under Section 9 of the Hindu Marriage Act i.e. HMA/2365/2023, titled 'Aman Prasher Vs. Shaweta Sharma', filed by the respondent-husband, pending in the Family Court, Amritsar and she seeks transfer of the same to the Court of competent jurisdiction at Derabassi, District SAS Nagar.

It is submitted by the counsel for the applicant that the applicant is residing at Zirakpur and the distance between Derabassi and Amritsar, is about 260 kilometres. Also, it is submitted that the respondent has not paid Anu 2025.03.26 15:58 I attest to the accuracy and authenticity of this document

TA-842-2024 any amount of maintenance to the applicant. The applicant is stated to be doing a private job at Zirakpur and on this account, she is residing separate. In view of the submissions aforesaid, I have gone through the contents of the applicant, which contains very sketchy facts and no detail, as such, has been given with regard to the date of marriage of the parties, or about any child born from the said wedlock. Even though, it is mentioned that the applicant is doing a private job at Zirakpur, but no other detail relating to the same has been given. Though, the distance between the two places is one aspect to be considered for adjudicating the transfer applications, but however, the distance alone is not a vital factor, more particularly, when it is coming forth that the applicant is doing a private job, though, details of the same have not been mentioned. In view of the aforesaid fact situation, the transfer application is hereby dismissed.
