This is an application filed under Order 33 Rule 3 read with Section 151 CPC seeking withdrawal of the appeal on the basis of settlement by way of affidavit dated 22.12.2025 (Annexure A-1) and order dated 23.12.2025 (Annexure A-2) passed by the Executing Court. 2.
Learned counsel for the applicant/appellant submits that the matter stands amicably settled between the parties, as a result of which, the execution petition stands dismissed as withdrawn, having been fully satisfied. 3.
He submits that under the circumstances, the appellants do not wish to pursue the present appeal and they may be permitted to withdraw the same.
