Mr. Vikram Singh, Advocate, for respondent No.3. PARAMJEET SINGH, J. (ORAL) Instant writ petition under Articles 226/227 of the Constitution of India has been filed for quashing the order dated 15.07.2010 (Annexure P-6) passed by Collector, Karnal and order dated 22.11.2012 (Annexure P-8) passed by Financial Commissioner, Haryana, whereby respondent No.3 has been appointed as Lambardar of Village Kunjpura, Tehsil and District Karnal.

I have heard learned counsel for the parties and perused the record.

Learned counsel for the petitioner submits that respondent No.3 has made a statement before the Assistant Collector Ist Grade, RAVINDER SINGH 2015.02.21 15:48 I attest to the accuracy and authenticity of this document

-2CWP No.4728 of 2013 Karnal, that he does not want to perform the duties of Lambardar anymore. Said statement has been affirmed by learned counsel for respondent No.3 in Court today.

Learned counsel for the petitioner further submits that Assistant Collector Ist Grade has recommended to discharge respondent No.3 from the post of Lambardar and for initiation of fresh process to fill up the vacancy.

In view of this, learned counsel for the petitioner does not press the present writ petition, however, submits that direction may be issued to the Collector to take decision on the statement of respondent No.3 in a time-bound manner.

Prayer of the learned counsel for the petitioner appears to be fair and equitable. Collector would take decision with regard to discharge of respondent No.3 from performing the duties of Lambardar within one month from today and thereafter invite fresh applications for filling up the vacancy of Lambardar, preferably within a period of two months from the date of receipt of certified copy of this order. Disposed of in above terms.
