**** RAJ MOHAN SINGH, J.(Oral) Petitioner seeks grant of regular bail in his second attempt in case bearing FIR No.73 dated 11.05.2020 registered under Sections 304-B and 34 IPC (offence under Section 34 IPC has been deleted later on) at Police Station Dhand, District Kaithal.

Earlier CRM-M No.42734 of 2020 was got dismissed as withdrawn on 21.01.2021.

The marriage of the petitioner was solemnized with Manju Devi on 02.12.2015. Manju Devi died on 10.05.2020 by hanging herself in the matrimonial house. The couple was blessed with two children namely Navya (daughter) aged 5 years and Dakshit (son) aged 3 years. CRM-M No.41682 of 2021(O&M) -2harassment at the instance of the petitioner and his family members under the pretext of dowry and persistent demand qua motorcycle etc.

Manju Devi died an unnatural death in her matrimonial house. Presumption under Section 113(B) of the Indian Evidence Act is attracted.

No ground is made out to entertain the second petition in view of facts and circumstances of the case, particularly when the complainant has been examined, who has supported the case of prosecution.

Dismissed.
