The husband of the petitioner was working as Lab Assistant with respondent No.3-College, which is an aided institution receiving 95% grant-in-aid from the State of Haryana. He retired on 31.8.2010 on attaining the age of superannuation and thereafter expired on 23.11.2014.

It is the case of the petitioner that this Court in CWP No.5492 of 1997 titled as Gurcharan Singh and others vs. State of Haryana and ors., decided on 20.11.2013 has held that the Lab Assistants working in aided colleges are entitled to pay parity with their counterparts working in Government Colleges. The petitioner has submitted representation dated 23.3.2014 claiming that her husband is also entitled for similar pay party in view of the aforesaid judgment.

Learned counsel for the petitioner states that at this stage he would be satisfied if a direction is issued to respondent No.2 to take a decision on the claim of the petitioner as contained in Dinesh Kumar 2015.12.25 13:21 I attest to the accuracy and integrity of this document show signature

Accordingly commenting on the merits of the case, this writ petition is disposed of with a direction to respondent No.2 to take a decision on the claim of the petitioner as contained in representation dated 23.3.2014 (Annexure P-5) in the light of the aforesaid judgment passed by this Court in CWP No.5492 of 1997 expeditiously, preferably within a period of three months from the date of receipt of certified copy of this order.
