The petitioner is working as Manufacturing Chemist in Jijnd Cooperative Sugar Mils Ltd.. He is physically disabled to the extent of 45% in relation to his PPRD(LL) Lower Limb as evidenced by the Disability Certificate, issued by the Medical Superintendent, General Hospital, Jind, vide Annexure P-1.

It is the case of the petitioner that in terms of the governments instructions (Annexure P-2) employees, who have more than 40% disablity are entitled to conveyance allowance, which are also applicable to the respondent-Sugar Mill. For claiming the aforesaid benefit, the petitioner has repeatedly representing the respondents and lastly he has sent legal notice dated 5.8.2015 (Annexure P-1) mentioning the aforesaid claim.

Learned counsel for the petitioner states that at this state he would be satisfied if a direction is issued to respondent No.2 to take a decision on the claim of the petitioner as contained in Dinesh Kumar 2015.12.25 13:21 I attest to the accuracy and integrity of this document show signature

Without commenting on the merits of the case, this writ petition is disposed of with a direction to respondent No.2 to take a decision on the claim of the petitioner as contained in legal notice dated 5.8.2015(Annexure P-11) in the light of the applicable government instructions expeditiously, preferably within a period of three months from the date of receipt of certified copy of this order.
