(ORAL) Prayer in the instant petition under Section 482 Cr.P.C. has been made for quashing FIR No. 123 dated 14.11.2008 (Annexure P-1) registered under Sections 447, 188, 506 and 511 IPC at Police Station Balachaur, District Shaheed Bagat Singh Nagar and all subsequent proceedings arising therefrom, on the basis of compromise Annexure P-6, effected in between the parties.

Pursuant to orders dated 27.08.2019 of this Court, the parties appeared before the Sub Divisional Judicial Magistrate, Balachaur, on 04.09.2019 to get their statements recorded. Learned Sub Divisional Judicial Magistrate, Balachaur, submitted her report vide letter No. 660 dated 24.10.2019, duly forwarded by the learned District and Sessions RISHU KATARIA 2020.03.03 11:11 I attest to the accuracy and integrity of this document

CRM-M-34665-2019 -2Judge, Shaheed Bhagat Singh Nagar, vide Endst. No. 964 dated 29.10.2019.

According to the report, learned Sub Divisional Judicial Magistrate, Balachaur, is satisfied that compromise effected between the parties is volutnarily, without any threat, coercion or undue influence. In compliance of order dated 29.01.2020, original receipts regarding deposit of costs of `20,000/- have also been produced in Court today. The same are taken on record. Be tagged at appropriate place. Considering the report of Sub Divisional Judicial Magistrate, Balachaur, dated 24.10.2019 and deposit of costs as well as the fact that the compromise will bring peace and harmony between the parties, aforesaid FIR No. 123 dated 14.11.2008 (Annexure P-1) and all subsequent proceedings arising therefrom, are quashed, qua the petitioner only.

Registry is directed to verify deposit of aforesaid costs, with the concerned quarter.
