* * * * S.J. VAZIFDAR, A.C.J. (ORAL) The petitioner is aggrieved by the proposed construction upon plot No. 18-B by respondent No. 5.

The petitioner's case is that he was allotted plot No. 19 and respondent No. 5 was allotted plot No. 18. He contends that as per the policy dated 11.03.1982 (Annexure P-4), no construction can be put up on plot No. 18-B. The policy expressly states that the allotment of the preferential corner plot is on the condition that the same would be used only for open purpose such as lawn garden etc. and no construction other than boundary wall will be allowed as it would spoil the street picture. 3.

The matter is pending before the Corporation. The 5th respondent's application for construction including on plot No. 18-B is pending before respondent No. 2 - Chief Administrator, Housing Board, Haryana. The petitioner has also represented against the proposed construction by his communication dated 25.05.2015 (Annexure P-6). The official respondents shall take a decision on the 5th respondent's application only after taking into consideration the petitioner's contentions.

The petition is accordingly disposed of.
