The petitioner through instant petition under Article 226 of the Constitution of India is seeking direction to the respondents to consider him for the post of Constable in police.

As per petitioner, he is member of terrorism affected family and he is eligible as per policy of the State for the post of Constable. The petitioner was offered post of Constable and thereafter, he was subjected to medical examination. The petitioner was twice subjected to medical examination. It is apt to notice that 2nd examination was conducted by the Medical Board consisting of three doctors of PGIMER, Chandigarh. Both the medical reports confirmed that due to low grade of colour perception, the petitioner cannot be considered for the post of Constable. Reply dated 23.01.2024 by way of affidavit of Gaurav Toora, IPS, Assistant Inspector General of Police, Pers-II, Punjab, is taken on record. Registry is directed to tag the same at appropriate place. 4.

Learned State counsel submits that medical reports are quite clear, thus, the petitioner cannot be considered for the post of Constable. He further submits that the petitioner vide communication dated 29.10.2018 has agreed for the post of all time contingent paid cook. As per his instructions, the authorities are ready to offer appointment letter to petitioner for the said post. 5.

Faced with this, learned counsel for the petitioner submits that his grievance would be redressed if respondents issue appointment letter for the post of Cook, as requested vide letter dated 29.10.2018. 6.

In the wake of statement of both sides, the present petition stands disposed of with a direction to the respondents to issue appointment letter to the petitioner for post of Cook (Class IV) within three months from today.
