HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH **** CWP No.27463 of 2015 (O&M) Date of Decision: 05.01.2016 **** Sajid Hussain & Ors.
... Petitioners VS.
State of Haryana & Ors.
... Respondents **** CORAM: HON'BLE MR.JUSTICE SURYA KANT HON'BLE MR.JUSTICE P.B. BAJANTHRI ****
Present:
Mr. Sanjeev Kumar Bawa, Advocate for the petitioners Mr. Anil Mehta, DAG Haryana **** SURYA KANT, J. (Oral) (1) Notice of motion. On our asking, Mr. Anil Mehta, DAG Haryana accepts notice on behalf of the respondents. In view of the directions which we propose to issue, it is not necessary to call upon the respondents to file their reply, at this stage. (2) The petitioners are residents of Village Neemkhera, Tehsil Ferozepur Jhirka, District Mewat. The bitter experience of violence and resultant registration of criminal cases including under Section 307 IPC at Police Station, Punhana in the previous elections held in their village has prompted the petitioners to approach this Court seeking transfer of the polling station of their village from Government High School (i.e. Booth No.115 & 116) to Government Primary School. The request has been declined by the authorities.

(3) We find from the record that CWP No.19157 of 2015 was earlier filed seeking identical relief. The said writ petition was disposed of on 28th September, 2015 after taking into consideration the stand taken by the respondents to the effect that Booth Nos.115 & 116 of village Neemkhera have been declared "hyper-sensitive" and senior officers of the District Administration have already visited the spot for making adequate security arrangements. This Court was further apprised of the fact that sufficient police force shall be deployed and video-recording of the entire polling proceedings shall be carried out. (4) In view of the categorical stand taken by the authorities, the instant writ petition is disposed of in same terms reiterating that the undertaking given by this Court in CWP No.19157 of 2015 be meticulously complied with. (5) Ordered accordingly.
