**** AMIT RAWAL, J. (ORAL) The petitioners have invoked the jurisdiction of this Court under Article 226 of the Constitution of India for issuance of a writ in the nature of certiorari quashing the impugned action of the respondents, whereby respondent Nos.4 and 5 have been given benefit of past service, which they have rendered in Districts Gurugram and Nuh as Patwaries before Transfer to District Palwal and with further writ of mandamus directing the respondents to consider them Patwaries of District Palwal w.e.f. 15.08.2008.

As per reply filed on behalf of the respondent(s)/State, respondent Nos.4 and 5 had never transferred on their request, therefore, benefit as sought by respondent Nos.4 and 5 is justified. The aforementioned contention has not been rebutted by filing any replication along with Rules establishing the act of the

Keeping in view the above, the present writ petition is devoid of merit and the same is hereby dismissed.
