(ORAL) Pursuant to the petitioner's application for permitting her to mortgage the flat, respondent No. 2 by a letter dated 06.01.2015 stated that the permission for mortgage was granted subject, inter alia, to the petitioner paying an amount of Rs. 3,90,640/- which was inclusive of penal interest and service tax. The petitioner paid the same under protest. The petitioner now seeks a refund thereof contending that the respondents are not entitled to the same. 2.

It is difficult from the record to determine the petitioner's case. It is in the first instance for the respondents to consider the petitioner's application for refund contained in the petitioner's advocate's letter dated 15.01.2016. The petitioner is at liberty to adopt appropriate proceedings, if necessary, after the decision.

The respondents are directed to take a decision on the petitioner's representation dated 15.01.2016 (Annexure P-11) as expeditiously as possible. 4.
