  FAO-1196-2012 JHARNA DEVI AND ORS VS HEMANT AND ANR

Present:

Mr. S.S. Khurana, Advocate for the appellants. Mr. P.H.S. Pannu, Advocate for Insurance Company.  A statement made on behalf of the appellants that in full and final satisfaction of their claim, an amount of Rs.5,00,000/- (Rupees Five Lakh only) over and above the amount awarded by the tribunal be awarded and be disbursed to appellant No.1-Smt. Jharna Devi, having been accepted on behalf of the insurer of the offending vehicle, the appeal is disposed of with a direction to the insurer to deposit with the office of the Lok Adalat a cheque in the sum of Rs. 5,00,000/- (Rupees Five lakh only) favouring appellant No.1-Smt. Jharna Devi, for and on behalf of all the claimants, within six weeks from today, failing which the amount hereby awarded shall carry interest @ 9% per annum from the date of this order till payment thereof.

On behalf of appellant No.1-Smt. Jharna Devi it has also been stated that in case of any dispute regarding apportionment amongst the appellants she shall satisfy claim of the other appellants. Appellant-Smt. Jharna Devi shall remain bound by the statement to the above effect.

The cheque so deposited may be collected by the above-named appellant or the counsel representing the appellants against proper receipt. Miscellaneous applications, if any, stand disposed of. A copy of this order be made available to each of the appearing counsel, and file be consigned.

Before we part, we must appreciate the efforts put in by the Mr. P.H.S. Pannu, counsel for the Insurance Company and Ms. Ajita Dixit, Legal Manager, ICICI Lombard GIC for getting the matter settled in spite of the fact that the claim petition was dismissed by the learned MACT.
