Petitioner Dr. Kulbushan Sain has brought the present civil writ petition under Articles 226/227 of the Constitution of India against respondents Indian Red Cross Society, Haryana, Deputy Commissionercum-President, Indian Red Cross Society, Faridabad and Indian Red Cross Society, District Branch, Faridabad craving for issuance of a writ in the nature of mandamus for issuing of direction to respondents to regularize his service and allow him regular pay scale in consonance with the principle of equal pay for equal work under Haryana Civil Services Rules.
As per the case of the petitioner, he is working as a Medical Officer with Red Cross Society on contractual basis on consolidated salary of Rs.15000/- per month for more than 9 months, therefore, keeping in view his work and conduct his services are required to be regularized and the salary paid to him at par with the regular appointees. According to him, he had submitted a representation addressed to Secretary, District Red Cross PARVINDER SINGH 2021.10.
CWP No. 20250 of 2021 Society, Faridabad dated 30.9.2021 (Annexure P-5) but that did not evoke any response.
Keeping in view the nature of the dispute between the parties as well as prayer made by the petitioner, for the purpose of enabling respondents to consider the claim of petitioner and then to take appropriate action, if need be and further to avoid unnecessary litigation, the writ petition is disposed of directing respondent No. 2 to consider the representation of the petitioner in accordance with law, rules, regulations and instructions on the subject within a period of two months from the date of receipt of copy of the order and if some action in the matter is warranted then the needful be done in accordance with law. A speaking order in that regard be passed, which be conveyed to the petitioner. For the purpose of such consideration, the present writ petition along with annexures be taken as additional representation by the petitioner. (H.S.
