Apprehending arrest the petitioner has filed this petition under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of anticipatory bail in case bearing FIR No.0009 dated 24.03.2025, under Sections 316(2) and 85 of BNS, 2023 registered at Police Station Women, District Patiala.

This Court on16.06.2025 passed the following order:- "1. Apprehending his arrest in FIR No.9 dated 24.03.2025, registered for the offences punishable under Sections 316(2), 85 of BNSS, 2023, at Police Station City Women, District Patiala, the petitioner has preferred this petition under Section 482 of BNSS, 2023 seeking pre-arrest bail.

2. Status report by way of affidavit of Gurpartap Singh, PPS, Deputy Superintendent of Police, Rural, Patiala Additional Charge of Crime against Women and Children, Patiala has been filed on behalf of respondent No.1. The same is taken on record. 3.

This Court while issuing notice of motion on 25.04.2025 passed the following order:- "Apprehending arrest the petitioner has filed this second petition under Section 482 of BNSS for grant of anticipatory bail in case bearing FIR No.0008 dated 22.01.2025, under Sections 376 and 506 IPC and Section 66(E) of IT Act, , registered at Police Station Urban Estate, District Patiala. The first petition bearing CRM-M-141992025 was dismissed as withdrawn with liberty to file fresh one with better particulars.

Learned counsel for the petitioner, inter alia, submits that petitioner has been falsely implicated in the present case on the allegations levelled by respondent No.2, who had been in a consensual relationship with the petitioner for the four years. Prior to this, the complainant has not lodged any complaint against the petitioner. It is also submitted that during the course of investigation undertaken in the present case, the allegations levelled against the brother and sister of the petitioner could not be substantiated, and thus they were exonerated by the investigating agency. Learned counsel further submits that the petitioner is ready and willing to join investigation and co-operate.

Notice of motion.

Mr. Randhir Singh Thind, DAG, Punjab, waives service of notice on behalf of Mr. Navdeep Singh, DAG, Punjab, accepts notice on behalf of the respondent-State and seeks time to file status report.

List on 16.06.2025.

4. Adjourned to 10.09.2025.

5. In the meantime, in the event of arrest, the petitioner shall be released on interim bail subject to his furnishing personal and surety bonds to the satisfaction of the arresting officer/Investigating Officer. As and when called, the petitioner shall join the investigation. He shall abide by the conditions enumerated under Section 482 of BNSS, 2023."

Learned State counsel on instructions from ASI Narinder Singh submits that in compliance of order dated 16.06.2025, the petitioner has joined the investigation and is not required for any further investigation. 4.

Having considered the aforesaid facts and circumstances, the petition is allowed. Order dated 16.06.2025 passed by this Court, is hereby made absolute.

This order should not be treated as "blanket" order. It will not be read granting the petitioner indefinite protection from arrest. It shall be confined to the FIR mentioned ibid and will not operate in respect of any other incident that involves commission of an offence. 6.

This order does not in any manner limit or restrict the rights or duties of the police or investigating agency to investigate into the charges against the petitioner.

The accused/petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the

case so as to dissuade him or her from disclosing such facts to the Court or to any police officer.

8.

The accused/petitioner shall not leave India without prior permission of the Court.

9.

The accused/petitioner shall join the investigation as and when called by the police.

10.

It will be open to the police or the investigating agency to move to this Court for a direction under Section 483(3) of BNSS (erstwhile Section 439(2) of the Code of Criminal Procedure, 1973) to arrest the accused, in the event of violation of any term, such as absconding, non-cooperating during investigation, evasion, intimidation or inducement to witnesses with a view to influence outcome of the investigation or trial. Pending application(s), if any, also stands disposed of accordingly.
