The petitioner who has been booked for commission of offences punishable under Sections 302 read with Section 34 of IPC and Section 25 of Arms Act, 1959 (for short "Act, 1959") in case bearing FIR No.216 dated 20.08.2023 registered at Police Station Chhansa, District Faridabad, has made prayer for release on interim bail on the ground that he is owner of some agricultural land and on 03.05.2023 had entered into an agreement to sell the same to one Smt. Rajwati resident of Village Garhkhera. The final date for execution and registration of sale deed had not been fixed. On account of his being in custody in this case, sale deed could not be executed so far. The buyer is ready and willing to get the same executed. It is, therefore, submitted that for the purpose of
-2execution and registration of sale deed, interim bail may be granted to him. 2.
After arguing for some time, learned counsel for the petitioner submits that if this Court is not inclined to extend benefit of interim bail to the petitioner then permission may be granted to him to appear before the office of Sub Registrar Ballabgarh/Faridabad while being in custody and direction may be issued to the jail authorities in this regard. 3.

Ms. Himani Arora, DAG, Haryana has advance notice of the petition and has not raised any serious objection to the submissions as made by the petitioner for ensuring his production before the concerned Sub Registrar in custody only.

This Court has considered the rival submissions. 6.
The petitioner is accused of commission of offence punishable under Section 302 read with Section 34 of IPC and Section 25 of Act, 1959. Keeping in view the gravity of the allegations, this Court is not inclined to extend benefit of interim bail to him. However, it is apparent from the material placed on record that the petitioner has executed a written agreement to sell his agricultural land in favour of one Smt. Rajwati. For the purpose of registration of sale deed in her favour, request has been made for allowing production of the petitioner before the concerned Sub Registrar. Keeping in view the circumstances as explained above, the petition is disposed of by giving direction to the Superintendent, District Prison Haryana to ensure production of the petitioner before the concerned Sub
-3Registrar on 09.06.2026 while being in custody. The expenses for hiring any vehicle etc. shall be borne by the petitioner himself. The police authorities of Police Station Chhansa, District Faridabad shall also ensure providing of requisite police force for the purpose of production of the petitioner before the Sub Registrar on the date fixed. Before sending him to the office of Sub Registrar from the jail premises, the Jail Superintendent shall, however, ensure that the requisite token for registration of sale deed by the petitioner has been issued by the Sub Registrar for 09.06.2026. 7.
A copy of this order be sent to the concerned Jail Superintendent as well as the police authorities for information and compliance.
