Mr. Bajaj submits that in view of the order passed in SLP No. No. 28657 of 2008, he may be allowed to withdraw this petition with liberty to approach the civil court.

Mr. Kapoor submits that in view of the order passed by Hon'ble Supreme Court it may not be possible to raise a question of jurisdictional error.

In view of above, present petition is disposed of. Petitioner shall be at liberty to avail remedy in terms of order dated 29.10.2013 passed in SLP No. 28657 of 2008.
