The present Civil Writ Petition has been filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of mandamus directing the respondents to fix basics the pay and seniority of the petitioners. 2.

Learned counsel would contend that the petitioners were appointed in the year 2018, pursuant to the advertisement dated 2006, on account of the fact that there was a dispute pending with regard to selection of the candidates having higher qualifications i.e. BPD. However, the persons, who were lower in merit, were appointed in the year 2006 and 2012 and the one's appointed in 2012, have been granted notional benefits with effect from the date, when the candidates lower them in the same selection list, were appointed, however, the petitioners have not been granted the same. In this regard, a representation dated 17.03.2020, Annexure P-10, has been submitted by them, which has yet not evoked any response, which, he thus, at this stage, on instructions, submits would satisfy the petitioners to direct respondents to decide in a time bound manner by granting them an opportunity of hearing.
