(ORAL) (The aforesaid presence is being recorded through video conferencing since the proceedings are being conducted in virtual court) Through this petition under Section 438 Cr.P.C. prayer has been made for giving direction to the SHO/IO to release the petitioner on bail in the event of his arrest in a case FIR No.53 dated 17.08.2009, under Sections 307, 186, 353, 332, 382, 511, 148 and 149, Police Station Sadiq, District Faridkot. Learned counsel for the petitioner submits that the petitioner was attending the trial court proceedings regularly, but unfortunately, he suffered from jaundice and due to that he absented from the court and he was declared proclaimed offender on 13.03.2015. CRM-M-36941-2020 --2-- acquitted but petitioner was not acquitted as he was declared proclaimed offender.

Perusal of file reveals that earlier the petitioner was granted interim bail vide order dated 23.05.2017, with the direction to appear before the trial court on 30.05.2017, but he misused the concession of bail and went to Malaysia. Now, he has again approached this Court by way of present petition for anticipatory bail. Considering overall facts and circumstances, petitioner is directed to appear before the ld. trial court on 17.11.2020 and file application for regular bail, which would be decided by the ld. lower court within a period of seven days after giving due notice to the opposite party.
