The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking setting aside of letter dated 03.04.2023 (Annexure P-5) and direction to respondents to issue his passport. 2.

The petitioner applied for passport and sought appointment. The petitioner on 26.11.2022 appeared before passport authority and submitted required documents. An FIR No. 98 dated 16.09.2010, under Section 429 of the Prevention of Cruelty to Animals Act, 1960 was registered against the petitioner at Police Station, Bariwala. CWP No.16063 of 2023 -2- 2023:PHHC:146057 issued notice dated 03.04.2023 calling upon the petitioner to submit court order with respect to afore-mentioned FIR.

Learned State counsel, on instructions from ASI Gurmeet Singh, submits that police after completing investigation has filed cancellation report and the same is pending for acceptance before trial court. 4.

Faced with this, learned counsel for Union of India asserts that passport authority would consider application of the petitioner and pass an appropriate order within six weeks from today. 5.

In the wake of statement of learned counsel for Union of India, the petition stands disposed of.

It is made clear that petitioner shall appear before passport authority as and when asked.
