The petitioner through instant petition under Article 226/227 of the Constitution of India is seeking setting aside of order dated 01.01.2026 (Annexure P-14) and consequential proceedings including order dated 02.01.2026 whereby Sub-Divisional Magistrate, Samalkha was appointed as Administrator for managing the affairs of the society. 2.

The petitioner is an Association which was set up as Society on 16.05.1978. At present, it is governed by provisions of Haryana Registration and Regulation of Societies Act, 2012 (for short '2012 Act'). It is affiliated to Judo Federating of India and Haryana Olympic Association. One person namely Nilesh-respondent No.4 filed complaint dated 18.02.2022 before District Registrar alleging that Association has not conducted elections for the last two decades. The Association in its

-2reply clarified that elections have been conducted after every four years. The Association initiated election process for the period from 2022-24 as per 2012 Act. Mr. Sunil Sansaniwal, Advocate was appointed as Returning Officer. The elections were concluded on 10.04.2022 and governing body was elected. Intimation dated 15.04.2022 was sent to District Registrar who had already appointed Mr. Dayanand as Administrator vide order dated 15.03.2022. Aforesaid Administrator resigned and Mr. Jagdish Kumar was appointed as fresh Administrator vide order dated 11.07.2022. The Association filed appeal before State Registrar against orders of District Registrar. The State Registrar vide order dated 02.08.2022 set aside orders passed by District Registrar. Respondent No.4-Nilesh filed appeal before Registrar General who vide order dated 28.09.

2022 passed ex parte interim order dated 28.09.2022 whereby operation of order passed by State Registrar was stayed. The District Registrar again appointed Mr. Tarsem Singh as Administrator vide order dated 15.10.2024. The Registrar General vide order dated 01.01.2026 directed the appointment of SDM Samalkha as Administrator of the Society to conduct elections. The District Registrar vide letter dated 02.01.2026 has appointed Mr. Amit Kumar, SDM Samalkha as Administrator of the society.

Learned State Counsel, on instructions from Mr. Rajesh Aggarwal, Additional Registrar of Societies, submits that Appeal No.488 of 2022 (Annexure P-11) would be decided within one month from today. 4.

Learned counsel for the petitioner agrees to the aforesaid arrangement.
