SURYA KANT, J.(ORAL) The petitioner was allotted Plot No.1436, Sector 57, Gurugram on 13.09.2006. As physical possession of the plot could not be given due to some litigation etc., he was given alternative Plot No.724, Sector 57, Gurugram on 03.10.2012. Unfortunately, the second plot is also under litigation and its physical possession could not be given to the petitioner. Meanwhile, it is stated that litigation qua the original plot bearing No.1436, Sector 57, Gurugram is over and the said plot is now free from all incumbrances. The petitioner, thus, seeks a direction for restoration of the original allotment qua Plot No.1436, Sector 57, Gurugram. In this regard, request of the petitioner, dated 30.07.2018 (Annexure P-6) is pending before the authorities.

[2] We have heard learned counsel for the petitioner and are of the view that if the facts mentioned in the writ petition are correct, the petitioner has made out a genuine case for re-allotment of the original plot.
