CWP-21344-2018 -1IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH CWP-21344-2018 Date of Decision: August 27, 2018 Akanksha .....Petitioner

Versus

State of Haryana and others ......Respondents CORAM: HON'BLE MR.JUSTICE SURYA KANT HON'BLE MR. JUSTICE SUDIP AHLUWALIA

Present:

Mr.Kartar Singh Malik-I, Advocate for the petitioner. ........

SURYA KANT, J.(ORAL) The petitioner was re-allotted residential plot No.1711, Sector 57, Gurugram vide letter dated 28.06.2005. The petitioner now wants to transfer the said plot in favour of a person other than her family member(s). It appears that HUDA authorities have asked her to get the conveyance deed executed as the title in respect of an immovable property, valuing more than Rs.100/-, cannot be passed on without a registered instrument of transfer. The petitioner, on the other hand, relies upon HUDA Policy/Circular dated 08.03.2000 and claims that since she has not deposited full installments, hence the plot can be further transferred by the authorities. [2] From the material on record, it is difficult for us to form any definite opinion regarding petitioner's claim. The writ petition is accordingly disposed of with a direction to respondent No.3 to decide the pending request, if any, made by the petitioner by way of a reasoned order MEENU 2018.08.31 10:43 I attest to the accuracy and authenticity of this document chandigarh
